Quem pode solicitar o apoio? • Pessoas físicas que atuam na área cultural, como artistas, produtores e técnicos. • Pessoas jurídicas de natureza cultural como autarquias e fundações. • Pessoas jurídicas privadas e de natureza cultural, com ou sem fins lucrativos, como cooperativas e organizações não governamentais. A proposta cultural pode ser em diversos segmentos, como teatro, dança, circo, música, literatura, artes plásticas e gráficas, gravuras, artesanato, patrimônio cultural (museu e acervo, por exemplo) e audiovisual (como programas de rádio e TV, sítios e festivais nacionais). A proposta deve ser aprovada pelo MinC e, se isso ocorrer, seu titular pode buscar recursos com cidadãos ou empresas. Estes últimos são chamados de incentivadores e têm parte ou o total do valor do apoio deduzido no Imposto de Renda devido. Como o incentivo pode ser feito? O incentivo a iniciativas culturais pode ser feito por meio de doação ou patrocínio. Somente pessoas físicas ou pessoas jurídicas sem fins lucrativos podem receber doações e, nessa modalidade, qualquer tipo de promoção do doador é proibido. No patrocínio, do qual qualquer proposta pode se beneficiar, é permitida a publicidade do apoio, com identificação do patrocinador, que também pode receber um percentual do produto resultante do projeto, como CDs, ingressos e revistas, para distribuição gratuita. Fundo Nacional de Cultura Outro mecanismo da Lei Rouanet é o Fundo Nacional de Cultura (FNC), constituído de recursos destinados exclusivamente à execução de programas, projetos ou ações culturais. Com os recursos do fundo, o MinC pode conceder prêmios, apoiar a realização de intercâmbios culturais e propostas que não se enquadram em programas específicos, mas que têm afinidade com as políticas da área cultural e são relevantes para o contexto em que irão se realizar (essas iniciativas são chamadas de propostas culturais de demanda espontânea). Para receber apoio do FNC, as propostas de demanda espontânea são escolhidas por processos seletivos realizados pela Secretaria de Incentivo e Fomento à Cultura (Sefic). As iniciativas aprovadas celebram um convênio ou um contrato de repasse de verbas com o FNC.
