The senate killed it when it voted viva voce yesterday to table the bill, which was passed yesterday by the house after a dramatic session. While no record vote was taken in the senate, the bill aws tabled by an estimated count of 25 to 6. It passed the house yesterday when two representatives changed their votes from no to aye, 50 to 47. Senate Richardson of Hoxie, gave notice he would ask for reconsideration of the senate action, but Lieutenant Governor Parnell ruled this out of order, as there was no record vote taken -- thus no official way of knowing how Senator Richardson voted. Arkansas Favors Ban on Evolution Little Rock, Ark, Nov. 7 -- A referendum prohibiting the teaching of evolution in all Arkansas schools, apparently has been adopted by an incomplete vote of 22,461 to 17.388. It was in protest against the proposed evolution ban that Charles Smith, president of the American Association for the Advancement of Atheists, conducted a campaign here which brought about his arrest and fine, [ The Border Cities Star - Nov 6, 1928 ] Anti-Evolution Bill Passes in Arkansas By United Press Little Rock, Ark, Nov. 8 -- The Arkansas anti-evolution bill, submitted to the voters Tuesday, apparently has won. In 665 precincts out of 2068, the vote today stood 31,373 for the bill and 22,956 against. "I do not anticipate any trouble", Dean Vinsohaler said. "I feel that no attempt will be made to enforce the law." Boyd Cypert, county presecuting attorney, said his office would not take the initiative in enforcing the law. If information is file with him against specific teachers or insititutions, he said he would attempt to prosecute. Arkansas anti-evolution act bars dictionary, state official claims Little Rock, Ark, Nov, 14 -- (UP)-- Arkansas recently enacted anti-evolution act took a new turn when J.P. Womack, state superintendent of public instruction, intimated that the monkey in the case may develop into a white elephant. Under a strict enforcement of the law. which prohibits the teaching of evolution in state educational institutions, Womack ruled that Webster s International Dictionary, the reference "world book," and the Encyclopedia Britannica are "bootleg books." And these books, considered safe, readable books in universities all over the country, are not to be permitted to "pollute" the minds of Arkansas students, according to the ruling of Womack. "I am in favor of the strictest enforcement of the anti-evolution law," Womack said in bringing comfort to the fundamentalists who have been active in having the state approve at a referendum, but his qualifications made the opponents of the law rejoice. "By strict enforcement only can we hope to secure a repeal of the measure," he declared. "Law enforcement would result in the law remaining on the books to be used only when some person desires to invoke it against it certain teachers." [ The Evening Independent - Nov 14, 1928 ]

Requirement for Balanced Treatment. Public schools within this State shall give balanced treatment to creation-science and to evolution-science. Balanced treatment to these two models shall be given in classroom lectures taken as a whole for each course, in textbook materials taken as a whole for each course, in library materials taken as a whole for the sciences and taken as a whole for the humanities, and in other educational programs in public schools, to the extent that such lectures, textbooks, library materials, or educational programs deal in any way with the subject of the origin of man, life, the earth, or the universe. SECTION 2. Prohibition against Religious Instruction. Treatment of either evolution-science or creation-science shall be limited to scientific evidences for each model and inferences from those scientific evidences, and must not include any religious instruction or references to religious writings. SECTION 3. Requirement for Nondiscrimination. Public schools within this State, or their personnel, shall not discriminate, by reducing a grade of a student or by singling out and making public criticism, against any student who demonstrates a satisfactory understanding of both evolution-science and creation-science and who accepts or rejects either model in whole or part. SECTION 4. Definitions. As used in this Act (a) "Creation-science" means the scientific evidences for creation and inferences from those scientific evidences. Creation-science includes the scientific evidences and related inferences that indicate (1) Sudden creation of the universe, energy, and life from nothing; (2) The insufficiency of mutation and natural selection in bringing about development of all living kinds from a single organism; (3) Changes only within fixed limits of originally created kinds of plants and animals; (4) Separate ancestry for man and apes; (5) Explanation of the earth s geology by catastrophism, including the occurrence of a worldwide flood; and (6) A relatively recent inception of the earth and living kinds. (b) "Evolution-science" means the scientific evidences for evolution and inferences from those scientific evidences. Evolution-science includes the scientific evidences and related inferences that indicate (1) Emergence by naturalistic processes of the universe from disordered matter and emergence of life from nonlife; (2) The sufficiency of mutation and natural selection in bringing about development of present living kinds from simple earlier kinds; (3) Emergency [sic] by mutation and natural selection of present living kinds from simple earlier kinds; (4) Emergence of man from a common ancestor with apes; (5) Explanation of the earth s geology and the evolutionary sequence by uniformitarianism; and (6) An inception several billion years ago of the earth and somewhat later of life. (c) "Public schools" mean public secondary and elementary schools. SECTION 5. Clarifications. This Act does not require or permit instruction in any religious doctrine or materials. This Act does not require any instruction in the subject of origins, but simply requires instruction in both scientific models (of evolution-science and creation-science) if public schools choose to teach either. This Act does not require each individual textbook or library book to give balanced treatment to the models of evolution-science and creation-science; it does not require any school books to be discarded. This Act does not require each individual classroom lecture in a course to give such balanced treatment, but simply requires the lectures as a whole to give balanced treatment; it permits some lectures to present evolution-science and other lectures to present creation-science. SECTION 6. Legislative Declaration of Purpose. This Legislature enacts this Act for public schools with the purpose of protecting academic freedom for students differing values and beliefs; ensuring neutrality toward students diverse religious convictions; ensuring freedom of religious exercise for students and their parents; guaranteeing freedom of belief and speech for students; preventing establishment of Theologically Liberal, Humanist, Nontheist, or Atheist religions; preventing discrimination against students on the basis of their personal beliefs concerning creation and evolution; and assisting students in their search for truth. This Legislature does not have the purpose of causing instruction in religious concepts or making an establishment of religion. SECTION 7. Legislative Findings of Fact. This Legislature finds that (a) The subject of the origin of the universe, earth, life, and man is treated within many public school courses, such as biology, life science, anthropology, sociology, and often also in physics, chemistry, world history, philosophy, and social studies. (b) Only evolution-science is presented to students in virtually all of those courses that discuss the subject of origins. Public schools generally censor creation-science and evidence contrary to evolution. (c) Evolution-science is not an unquestionable fact of science, because evolution cannot be experimentally observed, fully verified, or logically falsified, and because evolution-science is not accepted by some scientists. (d) Evolution-science is contrary to the religious convictions or moral values or philosophical beliefs of many students and parents, including individuals of many different religious faiths and with diverse moral values and philosophical beliefs. (e) Public school presentation of only evolution-science without any alternative model of origins abridges the United States Constitution s protections of freedom of religious exercise and of freedom of belief and speech for students and parents, because it undermines their religious convictions and moral or philosophical values, compels their unconscionable professions of belief, and hinders religious training and moral training by parents. (f) Public school presentation of only evolution-science furthermore abridges the Constitution s prohibition against establishment of religion, because it produces hostility toward many Theistic religions and brings preference to Theological Liberalism, Humanism, Nontheistic religions, and Atheism, in that these religious faiths general include a religious belief in evolution. (g) Public school instruction in only evolution-science also violates the principle of academic freedom, because it denies students a choice between scientific models and instead indoctrinates them in evolution-science alone. (h) Presentation of only one model rather than alternative scientific models of origins is not required by any compelling interest of the State, and exemption of such students from a course or class presenting only evolution-science does not provide an adequate remedy because of teacher influence and student pressure to remain in that course or class. (i) Attendance of those students who are at public schools is compelled by law, and school taxes from their parents and other citizens are mandated by law. (j) Creation-science is an alternative scientific model of origins and can be presented from a strictly scientific standpoint without any religious doctrine just as evolution-science can, because there are scientists who conclude that scientific data best support creation-science and because scientific evidences and inferences have been presented for creation-science. (k) Public school presentation of both evolution-science and creation-science would not violate the Constitution s prohibition against establishment of religion, because it would involve presentation of the scientific evidences and related inferences for each model rather than any religious instruction. (l) Most citizens, whatever their religious beliefs about origins, favor balanced treatment in public schools of alternative scientific models of origins for better guiding students in their search for knowledge, and they favor a neutral approach toward subjects affecting the religious and moral and philosophical convictions of students. SECTION 8. Short Title. This Act shall be known as the "Balanced Treatment for Creation-Science and Evolution-Science Act." SECTION 9. Severability of Provisions. If any provision of this Act is held invalid, that invalidity shall not affect other provisions that can be applied in the absence of the invalidated provisions, and the provisions of this Act are declared to be severable. SECTION 10. Repeal of Contrary Laws. All State laws or parts of State laws in conflict with this Act are hereby repealed. SECTION 11. Effective Date. The requirements of the Act shall be met by and may be met before the beginning of the next school year if that is more than six months from the date of enactment, or otherwise one year after the beginning of the next school year, and in all subsequent school years. 3-19-81 APPROVED (signed Frank White) GOVERNOR [ McLean v. Supp. Act 590 "Balanced Treatment for Creation Science and Evolution Science Act"(創造科学・進化科学均等州法)という名称のアーカンソー州Act 590 of 1981は公立学校で進化論と等時間の創造科学の授業を義務付ける。 McLean v. [7] References [1] Understanding the Intelligent Design Creationist Movement Its True Nature and Goals. 州法には unlawful for any teacher or other instructor in any university, college, normal, public school or other institution of the state which is supported in whole or in part from public funds derived by state or local taxation to teach the theory or doctrine that mankind ascended or descended from a lower order of animals, and also that it be unlawful for any teacher, textbook commission, or other authority exercising the power to select textbooks for above-mentioned institutions to adopt or use in any such institution a textbook that teaches the doctrine or theory that mankind ascended or descended from a lower order of animal.[1] 全部もしくは一部の費用を州政府もしくは地方自治体の資金でまかなっている、いかなる大学・公立学校・その他の教育機関の、いかなる教師や講師が、人類が下等動物から発達した、あるいは子孫であるという教義あるいは理論を教えることは違法である。 Epperson v. Susan Eppersonは、Little Rock学校群の教師で、Little Rock Central High Schoolで10学年の生物を教える教師として雇用された。 Upon the principal issue, that of constitutionality, the court holds that Initiated Measure No. 1 of 1928, Ark.Stat.Ann. § 81627 and § 81628 (Repl.1960), is a valid exercise of the state s power to specify the curriculum in its public schools. The court expresses no opinion on the question whether the Act prohibits any explanation of the theory of evolution or merely prohibits teaching that the theory is true, the answer not being necessary to a decision in the case and the issue not having been raised. The overriding fact is that Arkansas’ law selects from the body of knowledge a particular segment which it proscribes for the sole reason that it is deemed to conflict with a particular religious doctrine; that is, with a particular interpretation of the Book of Genesis by a particular religious group.[6] 修正すべき事実は、アーカンソー州法が知識の総体から特定部分を選んで、特定宗教グループによる創世記の特定解釈である、特定宗教教義と矛盾するという理由のみで、それを禁じている。 [T]he state has no legitimate interest in protecting any or all religions from views distasteful to them.[6] 州には、いかなる、あるいは全部の宗教を、それらにとって好まいくない見方から保護する正当な権限を持っていない。 Wright v. Addicott, Ohio State Law Journal, Vol. 63 1507, 2002 Timesの報道 U.P.L and Reuter. Arkansas school ban on Darwin overruled From DAVID SPANIER Washington, Nov. 12 The United States Supreme Court today struck down the Arkansas "monkey law ", which bans teaching of the Darwinian theory of evolution in the state schools. The statute in question forbids teaching the theory " that mankind ascended or descended from a lower order of animals ". Teachers who do so are liable to a fine of up to $500 (£208) and dismissal. The decision will also affect indirectly Mississippi, the only other state with an anti-evolution law on its books. The Supreme Court unanimously reversed a decision of the Arkansas Supreme Court upholding the state statute. Justice Abe Fortas, speaking for the higher court, said the "laws effort was confined to an attempt to blot out a particular theory because of its supposed conflict with the biblical account literally read. " The law in Arkansas was held to be contrary to the mandate of the first amendment and in violation of the fourteenth amendment to the constitution, the Supreme Court s opinion said. The first amendment guarantees freedom of religion and the fourteenth makes the guarantee binding on the states. Justice Fortas noted that there was no record of any prosecutions under the Arkansas statute and " it is possible that (it) is presently more of a curiosity than a vital fact of life" There had been some confusion during arguments on the case about whether the law forbade teaching that the Darwinian theory was true or merely teaching of its existence. Justice Fortas said this distinction did not matter, as under either interpretation it must be rejected because of its conflict with constitutional law. Suit brought by teacher The state of Arkansas had argued that it alone was responsible for the curriculum of its public (state) schools. Justice Fortas conceded that right, but said it could not conflict with constitional guarantees. " It is clear that fundamentalist sectarian conviction was and is the law s reason for existence ", he said. The suit was brought by Mrs John Epperson, aged 27, when she was teaching biology in the tenth grade at Little Rock s Central High School. She now lives in suburban Washington. She was joined in the suit by Mr. H. H. Blanchard, assistant secretary of the Arkansas Education Association and the father of school-age children. The "monkey law" gave rise to one of the most famous trials of the century, in Dayton, Tennessee, in 1927. This was when Clarence Darrow, the great criminal lawyer, defended a local teacher against the prosecution for the state by William Jennings Bryan, twice a defeated presidential candidate. Although Darrow lost the particular case -- the trial, conducted outside the courthouse under a big tree, attracted the attention of the entire nation by virtue of celebrity of the protagonists -- he was generally judged to have won the war for Darwin and freedom of speech. Cross-examination on Genesis The issue was not so much the advisability of teaching the theory of evolution as the relevance of fundamentalist biblical doctrine in the modern world. When the patriarchal figure of Bryan took the stand, Darrow subjected him to a point by point cross-examination on the Book of Genesis which, by contemporary accounts, was majestic in its forensic style and pitiful in its effect upon the prosecution. Bryan had sought to argue that the Tennessee law against teaching evolutionary theory was justified by reference to the literal truth of the Bible. Darrow showed that in seeking to uphold every single statement in the Book of Genesis as literal truth, the fundamentalists were ridiculous. It was not until last year, however, when a member brought a monkey in a cage into the Tennessee House of Representatives, that the law in the state was repealed. On this last occasion in Arkansas, Mrs. Epperson saw it was her duty as a biology teacher to explain scientific theories of evolution to her students, including that of Darwin. Washington, Nov. 12.-Justices Hugo L. Black, John M. Harlan and Potter Stewart, concurred separately in the Supreme Court judgment. The Arkansas law was passed in 1926, three years after the famous trial of John T. Scopes in neighbouring Tennessee on a similar charge.
